Auction Terms

These terms apply to every online auction on herizgallery.co.za. Please read them before you bid. When you tick the box and place a bid, you accept these terms and our Privacy Policy.

1. Who can bid

To bid, you need a Heriz Gallery account with your first name, surname, email address, mobile number and physical address. The site asks you to complete these details before your first bid. Your account is approved automatically once the details are complete.

Please keep your details correct. We use them to contact you if you win and to arrange delivery or collection. We may suspend or block an account that uses false details or does not pay for a won lot.

2. Your bid is a binding offer

• Every bid is final. A bid is a binding offer to buy the rug at that amount. You cannot cancel or reduce a bid once it is placed.
• Bid in full rand. Each lot shows its starting bid and the minimum amount by which the next bid must rise.
• Automatic bidding. You can enter the most you are willing to pay. The system then bids for you, one step at a time, only as far as needed to keep you in the lead.
• Last-minute bids extend the auction. If a bid is placed in the last minutes of a lot, the closing time moves later, so every bidder has a fair chance to respond.
• No bids from the seller. Heriz Gallery does not bid, and does not ask anyone to bid for it, on its own lots.

3. Starting bid and reserve

Each lot has a starting bid. The starting bid is also the reserve price: the lowest amount at which we will sell. The highest valid bid at the close wins.

4. If you win: payment within 48 hours

When a lot closes, we email the winner a secure payment link. You can also find it under "View Your Bids" in your account.

• You must pay the full winning amount within 48 hours of the winning email. You can pay by card, instant EFT or any payment option shown at checkout.
• We send reminders before the 48 hours end.
• If you do not pay in time, you lose the lot. We then offer it to the next-highest bidder, and we may block your account from future auctions.
• Until payment is received, the rug stays the property of Heriz Gallery.

Please bid only on rugs you intend to buy. Every unpaid win takes a rug away from another bidder.

5. Delivery and collection

The winning amount is for the rug only. Collection from our Fourways showroom is free. If you would like delivery, the delivery fee is fixed and shown at checkout when you pay. It depends on the size of the rug and your address. Delivery is only arranged once the rug and the delivery fee are paid in full.

6. Condition of the rugs

Many auction rugs are older, handmade pieces. They are cleaned and refurbished, but they are not new and may show wear, fading, repairs and small variations in size and shape. The photographs show the actual rug on auction. Measurements are approximate.

You are welcome to view any rug at our showroom before you bid, or ask us for more photographs or a video. Nothing in these terms limits your rights under the Consumer Protection Act, including the right to receive goods that match their description.

7. Returns

Online auction sales are not subject to the seven-day cooling-off period, because the Electronic Communications and Transactions Act excludes sales by auction. If a rug you receive does not match its description or photographs, contact us as soon as possible after you receive it and we will put it right, as set out in our Returns Policy.

8. When we may cancel a lot

We may withdraw a lot or cancel an auction before it closes, for example if a rug is damaged or a listing contains an error. If we cancel a lot after you have paid, we refund you in full.

9. Your information

We use your details only to run the auction, to contact you about your bids and wins, and to deliver your rug. Other bidders do not see your name. See our Privacy Policy for more information.
